1. Agreement Overview

This Builder CRM Affiliate Partner Program Agreement ("Agreement") sets forth the legally binding terms between you ("Affiliate", "you", or "your") and Builder CRM, a service operated by RED Media Network LLC ("Company", "we", "our", or "us") regarding your participation in the Builder CRM Affiliate Partner Program ("Program"). By joining the Program, you agree to comply with all terms outlined herein.

2. Eligibility

The Program is open to individuals and entities worldwide who are at least 18 years of age or older and legally capable of entering into binding contracts. Participation in the Program is void where prohibited by law.

We reserve the right to reject, suspend, or terminate any Affiliate for any reason, including but not limited to suspicion of fraud, abuse, or violation of this Agreement.

3. Compensation

3.1 Commission Structure

Affiliates will earn $25 USD for each qualified customer sign-up attributed through their unique referral link. A “qualified customer” is defined as:

A new paying customer (not a self-referral or duplicate),

Who maintains an active subscription for at least one full billing month, and

Remains in good standing for 90 consecutive days(without chargebacks, cancellations, or refunds).

3.2 Payout Schedule

Commissions are paid every 60 days after the customer’s first full paid month.

All payouts are made via the affiliate dashboard at https://affiliate.buildercrm.com.

A minimum payout threshold may be required as specified in the affiliate portal.

4. Tracking and Attribution

Referrals are tracked using cookies and affiliate software. We are not liable for any failure to track referrals due to:

Cookie deletion or blocking,

Incorrect or modified links,

Delays or technical issues beyond our control.

Final attribution is at the sole discretion of Builder CRM.

5. Prohibited Conduct

By participating in the Program, you agree not to:

Misrepresent Builder CRM or its services.

Engage in deceptive, fraudulent, or unethical marketing practices.Use spam, bots, or unsolicited emails.

Purchase PPC ads or bid on Builder CRM brand terms without written permission.

Offer discounts, rebates, or incentives not authorized by Builder CRM.

Use Builder CRM trademarks or logos outside approved use guidelines.

Violations may result in immediate termination and forfeiture of all pending commissions.

6. Intellectual Property and Brand Use

Affiliates may use approved Builder CRM branding assets solely for the purpose of promoting the Program. You may not:

Alter logos or materials,

Claim ownership or affiliation beyond the scope of this Program,

Register domains or social handles containing "Builder CRM" or similar brand identifiers.

All intellectual property remains the sole property of RED Media Network LLC.

7. Termination and Suspension

This Agreement may be terminated:

By either party at any time, with or without cause, by providing written notice.

Immediately and without notice by Builder CRM for any breach of this Agreement or behavior deemed harmful to the brand or Program.

Upon termination:

All licenses and rights to use Builder CRM materials are revoked.

Commissions earned for valid referrals prior to termination will be paid unless termination was due to a breach.

We reserve the right to suspend affiliate accounts during investigations of suspicious or abusive behavior.

8. Disclaimers and Limitations of Liability

We do not guarantee uninterrupted or error-free tracking or dashboard access.

We make no guarantees regarding potential earnings.

To the maximum extent permitted by law, Builder CRM disclaims all warranties, express or implied.

Our liability shall not exceed the total commissions paid to you in the past 6 months. In no event shall we be liable for lost profits, indirect, special, or consequential damages.

9. Indemnification

Affiliate agrees to indemnify, defend, and hold harmless Builder CRM, RED Media Network LLC, and its officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, or expenses arising from:

Your participation in the Program,

Your violation of this Agreement,

Any breach of applicable laws or rights of third parties.

10. Governing Law and Dispute Resolution

This Agreement shall be governed and construed in accordance with the laws of the State of Texas, without regard to conflict of laws. Any dispute arising under this Agreement shall be exclusively resolved in the state or federal courts located in Travis County, Texas.

11. Modification of Terms

Builder CRM reserves the right to modify this Agreement at any time. Changes become effective upon posting on our website or within your affiliate dashboard. Continued participation in the Program after such changes constitutes acceptance.

12. Entire Agreement

This Agreement represents the entire understanding between the parties and supersedes all prior discussions, agreements, or communications. No agency, partnership, joint venture, or employment relationship is created by this Agreement.
